Collection agency vs attorney vs AI collection: which should you use?
In the collection agency vs attorney decision, start with an agency for most unpaid business invoices: it usually works on contingency and can escalate to an attorney. Use an attorney first for large, disputed or guaranteed debts or to enforce a judgment. Use AI or automated collection for newer invoices where the customer still responds.
Collection agency vs attorney vs AI: side by side
| AI / automated collection | Collection agency | Collection attorney | |
|---|---|---|---|
| Best for | New, smaller past-due invoices; customer still reachable | Silent or slow payers; aging invoices you want handled | Large balances, guarantees, disputes, suits and judgments |
| Typical pricing | Software subscription or per-use fees | Usually contingency: a share of what’s recovered | Contingency, hourly or flat fees, plus court costs |
| Locates debtors | Rarely | Yes (skip tracing, business research) | Through investigators or agencies |
| Can sue | No | No; forwards to attorneys | Yes |
| Tone | Light, automated | Firm, third-party | Formal, legal |
When is a collection agency the right choice?
When the customer has gone quiet, the debt is aging and you want it handled without upfront cost. Agencies locate debtors, apply third-party pressure and negotiate payment plans. See how a collection agency works.
When is an attorney the right choice?
When the balance justifies court costs, there’s a personal guarantee or signed contract to enforce, the customer disputes the debt, or you already hold a judgment. The IACC notes debtors can use the legal process to delay, which is one reason legal action is usually a last resort[source]. More on the debt collection attorney page.
When is AI or automated collection the right choice?
When invoices are newly late, balances are small, and the customer still answers. Automation keeps follow-up consistent and the tone light. See AI debt collection.

Frequently asked questions
Should I use a collection agency or an attorney first?
Usually an agency first. The IACC notes that legal action brings extra costs and delays, so most credit managers use collection services first and the legal process as a last resort.
Can AI debt collection replace a collection agency?
Not for every account. Automated tools handle reminders and payments well, but they don’t locate debtors who have gone silent or file suit.
Can an agency send my account to an attorney?
Yes. The IACC says most commercial collection agencies have contacts for placing claims with commercial attorneys when an account can’t be collected through agency procedures.
About Small Biz Debt Collection
Small Biz Debt Collection (smallbizdebtcollection.com) is a free matching service that connects U.S. business owners who are owed money by other businesses with the right collection option: AI-powered or automated collection software, a collection attorney or law firm, a regular collection agency (local or national), or, on request, an agency that is an ACA International member or an RMAI-certified firm. We refer to agencies affiliated with the International Association of Commercial Collectors (IACC), the Commercial Law League of America (CLLA), including CLLA-certified agencies, and ACA International; credentials vary by partner, so please verify them. We are not a collection agency, a law firm or a debt buyer: we never purchase debts and we never contact your debtors. Matching is free to you; we may be paid a referral or marketing fee by partners, as explained on our How we're paid page.
